1. About these terms

These Terms of Use are an agreement between you and Depthonix ("we", "us") covering the Depthonix website, your user account, and purchases made through the website. By creating an account or using the website, you agree to these terms.

Use of the Depthonix application itself — including the Trial and Free versions — is governed by the End User License Agreement (EULA). Where these terms and the EULA overlap regarding the application, the EULA prevails.

2. Your account

To use the app and download the software you need a Depthonix account.

• ›Provide accurate information when registering and keep it up to date.
• ›Keep your password confidential — you are responsible for activity under your account. Two-factor authentication (2FA) is available and recommended.
• ›One account is intended for one person. Sharing an account to circumvent licensing is not permitted.

3. License purchase

A Full License is a one-time purchase at the price shown at checkout. It grants a perpetual, personal license as described in the EULA, active on one account and one device at a time. You can move your active device between machines whenever you need — deactivate the current device from your account page, then activate the new one.

4. Payments

Payments are processed by a secure third-party payment provider. We do not receive or store your full card details. The payment provider's own terms and privacy policy apply to the payment step.

5. No refunds

Every account gets a full-featured free Trial before buying, so you can confirm the software works with your glasses and delivers the experience you want.

Because the Trial exists for exactly this evaluation, all purchases are final and no refunds are provided after purchase.

6. Trial and Free tiers

The Trial and Free tiers are provided for evaluation. Their behavior, features, and limits may change, be reduced, or be discontinued at any time without prior notice, as described in the EULA.

7. Acceptable use

When using the website and services, you must not:

• ›Attempt to bypass, disable, or interfere with licensing, security, or access controls.
• ›Access the services through automated means that disrupt or overload them.
• ›Use the services for any unlawful purpose or in violation of the EULA's restrictions.

8. Intellectual property

The Depthonix software, website, name, logo, and all related materials are the property of the developer and are protected by applicable intellectual-property laws. Purchasing a license does not transfer any ownership rights.

9. Service availability and changes

Some features — sign-in, activation, and free-tier conversion — require an internet connection to our license service. We aim to keep the service available but do not guarantee uninterrupted operation, and we may update or modify the website and services over time.

10. Disclaimer and limitation of liability

The website and services are provided "as is" and "as available." To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from use of, or inability to use, the website or services. The warranty and liability terms for the application itself are in the EULA.

11. Termination

You may stop using the services at any time. We may suspend or terminate access to the services for a material breach of these terms or the EULA — for example, attempts to circumvent licensing.

12. Governing law

These terms are governed by the laws of Thailand, without regard to conflict-of-law principles.

13. Changes to these terms

We may update these terms from time to time. The effective date above reflects the latest version. Continued use of the website or services after an update takes effect constitutes acceptance.
